Exactly. Alot of people who complain about the "nanny state" then turn around to curse those who need government assistance. What if you and your family - who went out well prepared - had a medical emergency at sea while this nimrod was out "living his dream" and getting saved by the CG?

Stupid people like this cost us all money in the end.

boaters were taken to Dare County

Regional Airport in Manteo in good

condition. WRAL TV reports:

Recommended: 13 survival stories from around the world

A Coast Guard rescue ship

arrived at the damaged vessel

at about 4:05 p.m., but the 350-

foot cargo ship was unable to

come alongside the Rain

Maker.

An MH-60 Jayhawk helicopter

arrived at about 5 p.m. and

hoisted all five people from the

water.

“The mission today was

challenging for our crews due

to the distance from shore and

the weather conditions,” Petty

Officer 1st Class Allen Facenda,

an operations specialist in

Portsmouth who worked on

the case, said in a statement.

“The crew we rescued had a

registered and up-to-date

emergency position indicating

radio beacon that told us their

exact position. All five people

were wearing life jackets and

were prepared to abandon

their vessel in a life raft. We

were happy to get there before

that became necessary.”



I actually have a lot of factual information about this situation. As my dad is the lead investigator for the NY based insurance company that the owner carries his policy with..

All i can say is that they were headed to a large offshore sailing race in the islands. The boat was in the yard at the manufacture for work.. The cat is now considered salvage by maritime law as all occupants were removed by he USCG. A large commercial fishing boat ran south in the ditch to get south of the weather to make to slow chug out to the boat that was then 280 something miles offshore. USCG tracking bacon.

Their is more going on other than weather as this is an off shore racing boat that is designed to take the seas that it was in. Where as the FH was a homdepot built pile of shit and not a 5.5 million dollar carbon fiber racing machine..

But look at it this way. Last time I went to buy an oil filter at a big name auto parts store, it was the first time buying it for my new car and i was blown away by how expensive it was. I said its cheaper to have the dealer change the oil. He said without skipping a beat, "but you get the satisfaction doing it yourself."
So with that line of thinking Hotrod had the satisfaction of sinking his own vessel rather than a taking a carnival cruise and having their captain doing it for him....

how forget: labor, headache form the boat community in his yard, and he went to jail 2x bc he is a dumbass, kicked out of the marina because "the boat is an eye sore"

He would have been better off buying a WW2 landing craft. rebuilding a cummins 12v, and strapping a camper to the badge.

Update on NC carbon cat lost at sea. as of 8:30 east the fishing boat stopped searching for the night after 6hours of searching in 20' seas. They are on the coordinates the USCG is giving but with swells that big they could be in different wave valley and never see each other and be on top of it.

I read that the CG conducted over 2500 searches off the upper east coast this past year. Does that sound right?

So they have a 5.5 million dollar yacht and they get picked up by chopper. The boat flounders unmanned and gets claimed by finders keepers or is lost.....does insurance pay for the lost vessel?

well it is called Maritime law.

Concept of salvage under Maritime Law[edit]
The right to be rewarded for salvage at sea under common law is based both on equitable principles and public policy and is not contractual in origin. Historically, salvage is a right in law, when a person, acting as a volunteer (that is, without any pre-existing contractual or other legal duty so to act) preserves or contributes so to preserving at sea any vessel, cargo, freight, or other recognized subject of salvage from danger. This is the typical case of salvage and is distinct from Prize law, which is the rescuing of property from the enemy at a time of war, for which a reward is made by the Court of Admiralty sitting as a Prize Court.

The law seeks to do what is fair to both the property owners and the salvors. The right to salvage may not necessarily arise out of an actual contract but is a legal liability arising out of the fact that property has been recovered. The property owner who had benefit of the salvor's efforts must make remuneration, regardless of whether he had formed a contract or not. The assumption here is that when faced with the loss of his vessel and cargo, a reasonable prudent owner would have accepted salvage terms offered, even if time did not permit such negotiations.

ALL i can say is that the insurance company, boat manufacture and the commercial vessel are working together.. Their is a common interest to recover the boat in one piece.

As for the helo ride. when have only one operational engine and no steering it becomes hard to control a boat in 18' seas..

Yeah I get the finders keepers concept, but say I recover the 5.5 million vessel on open sea...I recon I may want to keep it or sell it for market value.

Question is...does the insurance company pay the owner the full agreed value of vessel? .....and does the rescued get a coast guard bill? Life Flight and Med Flight bill just like Ambulance service. CG flies out to cruise ship for medical transport....who pays? Cruise line, patient or nobody but taxpayers?

As for FW, yes I was pulling for him. I wasn't hoping he would fail and don't hope that for anyone. I get that he was not realistic, it wasn't the most beautiful thing afloat and all that. I never heard he stole anything or owed people to build it that didn't get paid. Was he wrong......obviously.....but no more wrong than someone setting out on a new million dollar yacht in conditions they aren't able to manage. I recon it comes down to relying on yourself and knowing your limitations. If there was no coast guard there may be fewer folks relying on them if that makes sense. I don't boat at night or if bad weather....Ive done both and neither I nor my boat are setup for it.

HOWEVER - there was some talk about criminal persecution for some individuals at one time.

As far as insurance, I do not know how maritime law would factor in. I know once insurance signs off - it is their property. There might be a legal fight in there as well.
