It's just going to sit here and not get used and I keep making payments on it every month and it just makes no sense to have it. Hopefully someone will realize that price IS a bargain and will come take it home.

Well I think I have the boat sold. Got a gentleman in Florida that wants to take her home. Need to call a notary monday and discuss any potential title issues since my Dad is on the title and is deceased (I have the original declerations of death so I should be ok).

I believe you just need the death certificate. When I bought my current both, he was deceased and she was still living. She just had to sign over the title and provide copies of the death certificate.

But the title was unencumbered correct? I still have an outstanding loan. I just want to make sure I cover all the bases before this gentleman drives 16 hours to pick up the 248. He wants to make it happen this week.

The title was in both of their names, and they had a loan. Loan was paid off, and signed by her. Sent to me with the death cert. That is all I needed to register it.

Dealing with loans and titles can be a pain. Just go down into your bank and find out what the process is. The death certificate is all you need, but sometimes releasing the title is a bit tricky.

It depends on if there is a 'paper' title that the bank physically holds, or is it electronic, and when it gets released, there is a process for transferring to a new owner.

A quick phone call to the bank should solve this.

I called the bank and they weren't much help.. Called the DMV, WHY DID I CALL THE DMV? That was an exercise in futility. I called the Dealer where I purchased the boat and also called the local messenger service and they both said "No big deal at all, just go to the notary with the original death certificates, one copy for the boat one for the trailer".

The buyer seems reluctant because of the situation, and I fully understand his apprehension. My name is on the title for both the boat and the trailer as is my name on the loan. I don't see how this is going to be an issue.

Am I missing something?

That's what I told the new owner. I wrote up a custom bill of sale we will have notorized stating that I have to release
the title as soon as I receive possession of the title. He's ok with that and he will be here Thursday morning!

Congratulations Brett! Too bad you'll still have to make some payments though but sometimes it's a wiser move to bite the bullet earlier rather than later when the item is a year older or the marketplace is winding down.
My inlaws turned down a guy who offered them 20K less for their cottage property last February and now they are still sitting on it paying, taxes, electrcity, maintemance etc... I told them they should have taken the offer since the proerty was overpriced to begin with.... They didn't listen and are now sorry they didn't.
