there must be tennants complaining of problems with many boats hanging out that dont live there. I know if i am trying to sleep and there is loud partying going on no matter who it is I would complain. Managment is just reacting to its complaints i am sure.

picking up your friends is one thing but hanging out is another thing. Time to find a new hang out in my opinion.
From Rics pictures of his female friends, looks to be a rowdy bunch. Show a little respect for the people that dont want to see that in there back yard.

Ric you keep saying the sandy beach was put in without permits but you sure seem to like what they did by using it right?

Look up "The Harbor at Lake Howell" on Google Earth. You will see the development, and Ric's lake, which measures about 1.25 miles long x .50 miles wide.

Like I said, no laws are broken on our side, not even close. We leave by sunset. I don't play music with the boat's stereo, if there is music played it's with someone's battery powered bluetooth speaker.

They're just zeroing out the boats, which doesn't make any sense cause 2 out of the 5 total that ever show up are tenants of the complex. Remove the boats won't remove the people.

If you arent being loud and rude and you are leaving by sunset then I dont see much of a problem. but I would avoid confrontation and look elsewhere

COMMON AREA LAW & LEGAL DEFINITION

Yes, but it's my backyard and it's really nice/easy to hop on the boat that's tied to the dock instead of trailering it elsewhere. It's only about a mile in diameter so yeah.. I topped off the gas tank LAST YEAR still have 1/4 tank left and I'm on it 1-2 times a week.

That's not our only spot to hang out on the lake, but it's the nicest. There's a peninsula that has a nice sandy beach. It's a river outlet so it's between 1in-12in of water deep for a big sandy area, and it drops off to about 10ft deep like a shelf. Perfect for beaching boats. We used to keep a BBQ Grill hidden there.

This is "the island". It is not accessible by land/walking. Boat only. No houses within 1000ft

But you aren't a tenant and don't live there...you are going on their property. If they ask you to leave then leave because you are not wanted there. If you are a guest of a tenant then that becomes an issue between the tenant and owner. You have no contract or expectation of right to access their property.

Take video and record them arresting you...good advice...the video and device become evidence and seized. You can watch the video along with the judge. You will be saying...see the mean people arresting me....the judge will be saying we see ric on somebody else's property and refusing to leave.

But hey, its your battle so go for it.

Florida doesn't work that way (neither does any state in the USA), in a multi-dwelling property the property management can't supersede the tenant in a decision of who's allowed on the property or not. The tenant is a paying resident and they have rights to that property and who is their guest or not. It's no different than if the president coming on your land and saying your buddy isn't allowed to drink beer in your bank yard anymore. He can't do that.

I already know my laws. You can't bully residents and tell them which guests they are allowed to bring and which they are not, it's not a totalitarian society. There isn't a law enforcement officer that can touch us as long as we're invited by a resident and I'm not breaking any laws or lease agreements.

You are wrong....criminal trespass applies once you have been provided notice by means of writing, verbal, posted or implied by fencing, marking or facility type, or by type of property (such as row crops in a field)...and then travel onto property. Notice can be provided by OWNER or some authorized to act for owner (such as apartment management) and includes both single family residences and MULTI-FAMILY residences......

If in Texas they could and WOULD arrest you...place you in jail....and charge with criminal trespass, which is a class B misdemeanor....then i would attach this forum entry showing you had been provided notice....knew you had notice....and continued to travel onto property.....section 30.05 Texas Penal Code....

In Texas that off duty officer has authority to arrest you for this on site if he ses you do this....no warrant, no questions and doesn't matter if it occurs within his/her immediate area of jurisdiction.

Last I checked Texas is a State in the USA and has been since we joined the Union after being a country, which was after defeating Mexico and Santa Anna at the battle of San Jacinto.
